Regulatory Framework for Your Digital Identity
Below are two versions of a set of guidelines that support innovation for AI without sacrificing individual autonomy. The first version is what I believe is needed. The second version focuses on securing data, rather than regulating AI. This one was developed due to the proposed ten-year moratorium on AI regulation and enforcement. Although it has currently been removed, this version remains a starting point for data protection.
Version 1: The Digital Integrity and Personal Autonomy Act (DIPAA)
Policy Purpose:
To safeguard individual autonomy, limit invasive surveillance, and impose strict controls on the use, transfer, and manipulation of personal data by public and private entities, including through AI systems, APIs, and data brokers.
Section A – API Access Transparency and Control
All applications must disclose every external API used to collect, transfer, or analyze user data.
Users must be able to view, audit, and revoke any API access in real-time.
Any cross-platform or cross-device data sharing must require explicit, informed, and revocable consent.
Data chains must be maintained for a specific period of time. Regular audits must be done to remove any data obtained from the dark web, hacks, and/or leaks.
Section B – Ban on Behavioral Profiling Without Consent
Companies are prohibited from creating or selling psychographic, predictive, or behavioral profiles of individuals without opt-in consent.
Inferences about mental health, political beliefs, religious views, sexuality, or economic vulnerability must be classified as sensitive data and protected under enhanced restrictions.
Section C – Biometric and Facial Recognition Limits
Real-time facial recognition is banned in public and quasi-public spaces (e.g., malls, schools, transit) unless authorized by a warrant or court-reviewed emergency order.
Biometric data may not be collected, stored, or shared without clear, opt-in consent.
Section D – Algorithmic Accountability and Explainability
Any AI system used to make determinations about credit, employment, policing, education, or healthcare must:
Be auditable
Provide a clear explanation of how decisions were made
Include a mechanism for appeal or human override
Section E – Universal Privacy Opt-Out Infrastructure
Establish a federated digital rights dashboard, enabling users to:
Opt out of data sale/sharing across all platforms with one action
Automatically transmit “Do Not Profile” and “Do Not Track” signals from their devices
Tech companies must honor this opt-out across browsers, devices, and apps.
Version 2: The People’s Data Sovereignty Act (PDSA)
Policy Purpose:
To ensure citizens retain control over their personal data, demand transparency in data use, and opt out of third-party data sharing, even if direct AI regulation is not possible.
Section A – Mandatory API and Data Use Disclosures
All apps, websites, and platforms must publish a machine-readable API disclosure file, listing:
All APIs called
Data types shared or received
Third-party endpoints involved
Section B – Enhanced Data Portability and Consent
Every individual has the right to download, delete, or transfer their personal data across services at no cost.
Companies must request renewed consent if data is used for a materially new purpose.
All user data must be separated by function (analytics vs. marketing vs. profiling) and consented to individually.
Section C – Opt-Out of Profiling and Data Brokerage
Users must have a clear, standardized option to opt out of profiling and the sale of their personal data.
Data brokers must maintain a public registry and provide one-click removal tools.
Government agencies are barred from purchasing commercial data without a warrant.
Section D – Citizen Privacy Reporting Portal
Create a national online platform for people to:
Report data misuse
Request audits or deletion from specific companies
Learn how their data is used or sold
Section E – Civil Penalties and Private Right of Action
Individuals may sue companies for unauthorized sharing, monetization, or retention of personal data.
Civil penalties increase for repeat offenses and vulnerable population targeting (e.g., children, elderly, marginalized groups).
